How to behave if drugs are planted! Instructions!
A subscriber contacted me with a question: what to do if a drunk person was riding a commuter train and police officers approached an empty carriage at the final station and planted drugs. Is it possible to avoid punishment? Or will the truth not be found?
First of all, if such a situation occurs, you must immediately come to your senses and turn on your head! This is the most important thing! If possible, call 911 and a lawyer you know.
1. Situations can be different. It depends on where they planted the drugs: in your pockets or in your bag.
If in your pockets, do not dare touch the package under any circumstances. Because your traces will remain on it later. You should also not throw it away, it will simply be confiscated from the floor, the officers will report that you dropped the package, on which your biological traces will remain later.
Pay attention to the people around you, perhaps there were any witnesses. And also whether there are CCTV cameras in the surrounding area. This is very important.
2. Immediately demand that your hands be swabbed and your nails cut.
If you yourself, through carelessness, pulled a bag out of your right pocket with your right hand, then the microparticles will remain on your right hand. But they will not be on your left! This is your advantage.
P.S. Refusal to swab your palms and cut your nails became one of the weighty arguments for innocence in the Golunov case.
3. Demand that microparticles be confiscated from all your pockets. In which, accordingly, nothing will be found. Except for the particles in the pocket with the planted bag.
4. Demand that the search report specifically indicate what exactly was taken and from which pocket!
5. After the search is complete, do not touch anything with your hands and do not reach into your pockets after "your" bag of drugs has been taken.
Also, a very important point: during the search, DO NOT TOUCH THE BAG. Before the search, tell the witnesses that there is a small bag in your pocket that does not belong to you and was planted by the police. And you will not touch it, let the police officer take it out himself.
6. Carefully read the search report and make sure that the seized bag is properly sealed and that the packaging has the signatures of the witnesses.
If you are denied all of the above (swabbings, removal of microparticles, etc.), then be sure to write comments to the report: that you demanded this, but you were refused, and that this fact is confirmed by the witnesses.
7. If you doubt the objectivity of the witnesses (perhaps these are the so-called "pocket", "duty"), then demand that others be provided, but do this before the search. If this is also refused, then write all this in the comments to the report.
Reflect all the moments and circumstances in the personal search protocol.
The personal search protocol is one of the main documents on the basis of which a criminal case is initiated. There is no point in not signing the documents. On the contrary, try to reflect as much as possible in the protocol on the illegal actions of the police officers.
Before the personal search, insist on video recording. Loudly voice all the nuances: Which specific officer, under what circumstances, when planted a bag of a substance that did not belong to you.
After the seizure, you will be taken to the duty station, where you will wait for the results of the study. Demand a phone call, tell your relatives that drugs were planted on you. Give the address of the territorial department where you are located. For a lawyer to go to the place. If the lawyer is smart, he will call the Internal Security Department himself and report what happened.
P.S. I also recommend insisting on a medical examination for drug intoxication.
1. No drugs
2. No traces on palm/nail swabs
3. No particles in your other pockets
This is the key to your success.
Tell your staff about it, give all the above arguments, they will probably give up on this idea.
