This rule is being discussed in the Federation Council as part of the work on the draft law on cyber insurance.
Russian citizens can start receiving compensation from the gosuslugi portal in case of leaks of their personal data after the adoption of the law on cyber insurance, Senator Artem Sheikin said.
According to him, if there is a data leak from Gosuslugi, the Ministry of Digital Resources will pay compensation to citizens from its own funds, as the operator of personal data. Recall that the Ministry itself in April last year took the initiative to use the portal "Gosuslugi" as a third party in the process of paying compensation for personal data leaks.
Sheikin noted that following the discussion in the Federation Council on the relevant topic, recommendations were sent to the federal executive authorities to work out mechanisms for assessing the protection of organizations from " real threats in terms of their applicability to the legislation on turnover fines that is being developed."
"It is important that operators working with personal data have financial security to pay compensation in case of data leaks and damage caused to citizens In the case of state organizations, compensation in favor of citizens is also possible — they can be paid either from the budget or from the financial resources of the direct culprit of the leak," the senator stressed.
In January, the State Duma of the Russian Federation at the plenary session in the first reading adopted a bill on the introduction of fines for violating certain requirements of the legislation in the field of personal data. It is assumed that the maximum fine for legal entities can be up to 3% of their annual revenue (but not less than 20 million rubles and not more than 500 million rubles).
The document was submitted to the State Duma in December 2023 by a group of senators and deputies led by First Deputy Speaker of the Federation Council, Secretary of the General Council of United Russia, Andrey Turchak.
According to the draft law, it is proposed to introduce new parts to Article 13.11 of the Administrative Code of the Russian Federation (violation of the law on personal data).
