Europol expressed serious concern about the impact of home routing on the ability of law enforcement agencies to obtain important evidence. Criminals actively use this practice to evade the law.

Home Routing is a service that allows customers abroad to process calls, messages, and data through their home network, rather than through the host country's network. Because of this, foreign service providers cannot transfer data to law enforcement agencies, creating a loophole for intruders.

How it works

1. Travel: when a customer with a home SIM card travels to another country, their mobile device connects to the local network, but all data transmission is routed through the home network of their home provider.

2. Data processing: Calls, text messages, and Internet traffic are processed through the home provider's servers as if the customer were staying in their home country.

3. Feedback: information about calls, messages and other data is returned via the local network to the client.

Once home routing is activated, any suspect with a foreign SIM card becomes unavailable for interception. The problem occurs both when a foreigner uses their SIM card in another country, and when citizens use a foreign SIM card in their own country. The only exception is when the "home" provider has a cooperation agreement with a foreign provider that disables home routing.

Criminals are aware of this loophole and actively use it to evade law enforcement agencies. In the case of home routing, National intercept warrants do not apply abroad, and the police have to rely on a European Investigation Warrant, which can take up to 120 days to respond. In an emergency, this is too long.

Europol emphasizes that dependence on the voluntary cooperation of foreign service providers for investigative actions is undesirable. It is necessary to find a solution that will allow the authorities to legally intercept the communications of suspects on their territory, without violating the right to secure communications.

While Europol describes this as a technical issue, it fits in with the broader debate about privacy rights in the EU. Controversial proposals for mass scanning of private messages in encrypted messengers such as Signal and WhatsApp are being considered to facilitate the detection of CSAM materials. However, critics express concerns about creating a backdoor for hackers or third-party interventions.
