Former deputy minister convicted in abuse of power case

Savelovsky Court of Moscow has passed a verdict in the criminal case of former Deputy Minister of Communications of the Russian Federation Alexey Soldatov and General Director of Relcom Group LLC Evgeny Antipov. They were charged with abuse of authority: as the investigation and the court found, in 2018, the defendants removed about 490 thousand IP addresses of the fourth version of the protocol (IPv4) from Russia in favor of the Czech company Reliable Communications s. r.o. However, the transfer of IP addresses was subsequently canceled. As a result, Alexey Soldatov was assigned two years in a penal colony, and Evgeny Antipov-one and a half.

Alexey Soldatov and Evgeny Antipov, who at the time of the verdict were released on their own recognizance, arrived at the Savyolovsky court building surrounded by relatives and lawyers. The meeting itself did not take much time. From the announced court decision, it followed that both defendants were found guilty of "abuse of power with causing significant harm to the rights and legitimate interests of citizens" (Part 1 of Article 201 of the Criminal Code of the Russian Federation) and sentenced respectively to two and one and a half years in a penal colony. In the debate, the prosecutor demanded to send everyone to the same place for three years.

Former Deputy Minister Alexey Soldatov and General Director of Relcom Group LLC Evgeny Antipov were detained on December 12, 2019 as part of a criminal case initiated initially by the main investigation department of the Metropolitan Police under Part 4 of Article 159 of the Criminal Code of the Russian Federation (fraud on a particularly large scale). After being interrogated as accused, the defendants were taken to the Tverskoy District Court of Moscow, which placed them both under house arrest, although the investigation requested that they be taken into custody. In 2020, both were released on their own recognizance.

The plot of the case was based on the story of the withdrawal in 2018 of about 490 thousand IP addresses from the Russian Research Institute for the Development of Public Networks (RosNIIROS) in favor of the Czech company Reliable Communications s.r.o.

Evgeny Antipov signed the corresponding agreement on behalf of RosNIIROS. As Kommersant previously reported, this happened shortly before the termination of the Local Internet Registry (LIR), which distributes IP addresses. As Kommersant wrote, many clients of the LIR RosNIIROS, including commercial and state structures, after the termination of its activities were forced to pay for the rental of IP addresses to the Czech structure, which was accompanied by an increase in tariffs.

The deal was subsequently canceled.

In 2022, the charge was reclassified from fraud to abuse of power. The final version stated that as a result of the concluded transactions, RosNIIROS Autonomous Non-profit Organization lost the ability to carry out activities related to the allocation of address space, as well as the ability to extract income in the amount of 3,196,710 rubles for the period from April 5, 2019 to December 31, 2022.

Alexey Soldatov and Evgeny Antipov did not plead guilty either at the investigation or in court, insisting that the investigation unreasonably transferred an ordinary civil transaction to the criminal plane.

The lawyers also insisted on the acquittal of the defendants, pointing out that such transfers of addresses at the time when the case was initiated were common practice and did not contradict the law. They also reminded of the former achievements of Alexey Soldatov. Alexey Soldatov, Doctor of Physical and Mathematical Sciences, worked at the Kurchatov Institute of Nuclear Energy (now the Kurchatov Institute Research Center) until 2008. With his participation in 1990, the Relcom information network was created there, which is usually associated with the emergence of the Internet in the country and with the further emergence of the Runet. In 1995-1998, he was an adviser to the General Director of FAPSI, and managed the Business Network of Russia project.

From 2008 to 2010, he held the position of Deputy Minister of Communications and Mass Media of the Russian Federation, supervised the strategic and scientific and technical development of the industry, and led the project "Development of Supercomputers and Grid Technologies". In 2010, he was the vice-rector of Moscow State University, then - advisor to the rector. He is the author of more than 60 scientific papers, for which in 2010 he was awarded the Certificate of Honor of the President of the Russian Federation and the gratitude of the Minister of Communications and Mass Media. Alexey Soldatov also won the Runet Prize and the Kurchatov Prize twice.

After the announcement of the introductory and operative parts of the verdict, a guard entered the hall, asking Alexey Soldatov and Evgeny Antipov to enter the cell for the defendants. They were handcuffed and then taken to the guardhouse.

IP Address theft case

The criminal case was initiated in 2019. Then the organization RosNIIROS (Russian Research Institute for the Development of Public Networks), headed by Soldatov, transferred 490 thousand IP addresses to the Czech company Reliable Communications, owned by Soldatov and Shkitin. These IP addresses were used by government agencies, and the change of their owner led to an increase in the cost of relevant services, which caused dissatisfaction with the authorities.

Andrey Lipov, head of the Department for the Development of Information and Communication Technologies and Communications Infrastructure of the Russian Presidential Administration (currently heads Roskomnadzor), filed a criminal complaint.

Soldatov and Antipov were placed under house arrest, and Shkitin left Russia. The case was initiated under Part 4 of Article 159 of the Criminal Code (fraud on a particularly large scale).

After that, the IP addresses were returned to RosNIIROS. In 2020, Soldatov and Antipov were released from house arrest on their own recognizance. In 2022, the case was reclassified to a lighter article on abuse of power.

What is Alexey Soldatov known for?

Alexey Soldatov was one of the founders of the Runet. In the 1980s, he headed the Computing Center of the I. V. Kurchatov Institute of Atomic Energy, in the depths of which the Relcom network was created. In 1990. it gained access to foreign networks.

Then, on the basis of Relcom, a commercial Internet provider of the same name was created, which was managed by Soldatov. In the 1990s, the organization also worked closely with the FAPSI (Federal Communications and Information Agency).

Soldatov also ran RosNIIROS, a non-profit organization that coordinated the development of the Russian Internet in the 1990s. The organization was also a regulator and the only registrar in the domain zone .Ru. RosNIIROS also created the first and still largest traffic exchange point MSK-IX.

In the early 2000s, RosNIIROS began to lose its status. The functions of the .ru zone administrator were transferred to the Coordination Center of the National Internet Domain (CC). The domain registration functions were transferred to Ru-Center, which was bought by RBC Holding in 2011. MSK-IX was transferred to the Safedata Group, which has been controlled by Rostelecom since 2015.

RosNIIROS focused on servicing scientific and educational organizations.

In 2008-2010, Alexey Soldatov served as Deputy Minister of Communications (then Igor Shchegolev was the minister). He oversaw Internet issues, including the launch of the kirrilic .RF domain zone.

Fight for the domain zone of the Secular Union

Another project related to Soldatov is the domain zone .Su, which was originally assigned to the Soviet Union. In 1994, with the advent of the zone .Ru, domain development .Su was suspended, but in the early 2000s domain registration in this zone resumed.

Formally, the domain zone administrator was RosNIIROS, but the zone was managed by the Internet Development Fund, which was managed by Soldatov's wife Galina. In 2019, after the adoption of the law "On the Sovereign Internet". Roskomnadzor was instructed to create a National domain zone. It includes more than just zones .Ru and .Russian Federation, but also .Su.

In 2020, the rights to manage the zone .Su moved from the Internet Development Fund to RosNIIROS. At the same time, Roskomnadzor became one of the founders of RosNIIROS. All this coincided with the end of the house arrest of Soldatov and Antipov.
