According to ANO Tsifrovaya ekonomika, if we facilitate the access of third parties to banking, medical and tax secrets, as well as weaken the secrecy of communication, this will allow the development of new technologies and is unlikely to harm security.
The Autonomous Non-Profit Organization (ANO) Digital Economy is implementing a grandiose program of the same name, on which they plan to spend 3.5 trillion rubles. The problem, experts say, is that many good proposals cannot be implemented due to outdated legislation. For example, this is hampered by numerous professional secrets: communication secrets, banking, tax or medical secrets. A bill to expand access rights to information that is closed because of this is already ready, says RBC.
These changes are a step towards the possibility of developing related digital services based on payment information, explained the head of the development department of the Skolkovo Foundation (responsible for the Normative Regulation direction) Sergey Izrailit. They should remove from banks the risk of recognizing this or that information they transmit as bank secrets. Izrailit believes that such a change will not only empower bank customers, but also give other organizations the ability to process customer financial data and provide commercial services based on that information. However, this will happen at the request of the clients themselves and subject to the consent of the banks, Izrailit emphasized.
The concept of the secret of communication, according to experts of the Digital Economy, must be weakened for another purpose - this is the fight against fraudsters. Operators will be able to transfer subscriber data to third parties. The only one among the operators of the Big Three who commented on the innovation is Megafon.
They said that the processing is "necessary ... for the high-quality provision of services", as well as for the automated exchange of information between the operational intelligence services and operators
Now a number of technical data of phones, including the IMEI identifier, are classified in the courts as a secret of communication, and their transfer would stimulate the development of new digital services and facilitate the fight against fraudsters, the operator assures. Experts admit that operators will use the opportunity to legally provide information from messages transmitted over communication networks to monetize data for marketing and other purposes.
With the updated tax secret, it will be easier to settle accounts with the state.
It is proposed to amend the Tax Code to transfer data on taxes and fees charged and payable by individuals from the database of the Federal Tax Service (FTS) to the Unified Portal of State Services. Now this information is a tax secret. And only information about the debt gets to the portal of public services. Because of what it is more convenient not to pay on time, but to wait for the data to emerge online in the form of debt, experts explain.
Medical secrecy must be limited for the development of telemedicine.
The bill proposes to expand the list of persons to whom medical secrets can be transferred with the consent of the client. Now the responsibility for its disclosure lies solely with the officials. After the adoption of the amendments, organizations will also be able to carry it.
As experts explain, this will pave the way for the creation of modern intermediary services between a medical institution and a client. They will be able, for example, to order specialized research with the involvement of third parties. “The bill proposes to add to the legislation a norm that organizations can also be recipients of such information and be responsible for it,” Izrailit said. He believes that the responsibility for protecting information today is more connected with the information security infrastructure than with the competencies of individuals, and therefore it is quite logical to transfer the responsibility to the organization.

- The concept of banking secrecy includes information about operations, accounts and deposits of clients of a credit institution.
- Tax secrets are any data received by the tax authority, internal affairs bodies, etc. about a taxpayer or payer of insurance premiums. Exceptions are TIN, data on debts and a number of others.
- Medical secret - information about the fact of seeking medical help, health status, diagnosis and other information about a patient obtained during his examination and treatment.
- The secrecy of communication includes the content of telephone conversations, correspondence, postal items and any messages transmitted over communication networks or mail.
