The Uzhgorod resident used an ATM exploit, thanks to which he topped up his cards with UAH 90,000 without spending cash

The Uzhgorod city district court of the Transcarpathian region sentenced a Ukrainian who found a way to deceive an ATM. Thanks to the exploit, the bank credited money to his account, and the ATM returned the deposited funds in cash.

The court found that the Uzhgorod resident had a criminal intent aimed at unlawfully seizing funds from JSC State Savings Bank of Ukraine. To do this, he used the ATMs of this bank.

How the fraudulent scheme worked

The man topped up his bank card of JSC FUIB with cash, after which the system sent a request to VISA and then to the issuing bank to authorize the operation.

After receiving a response from the issuing bank confirming the completion of the operation to replenish the card account, the ATM received a message about a successful operation from the issuing bank of FUIB JSC and a command to accept cash. However, when processing the data received from the bank, the bank payment card used by the fraudster rejected the transaction with a processing error by the card chip. As a result, the bills he deposited did not end up in the ATM deposit cassette, but were returned along with the card to the owner.

However, taking into account the fact of a successful operation to replenish the client’s account from JSC State Savings Bank of Ukraine, funds were credited to the bank payment card account in the amount in accordance with the replenishment amount.

The Uzhgorod resident carried out a number of such operations from November 29, 2021 to January 17, 2022, “topping up” the card with amounts ranging from 500 to 7,500 hryvnia. In total, he managed to steal 90,554 UAH from Oschadbank in this way. At the trial, the bank representative asked the court to recover UAH 91,950 from the accused.

What did the court decide?

The Uzhgorod City District Court took into account that the fraudster sincerely repented of his crime, actively contributed to solving the crime and gave a confession. In addition, he had a disability of the first group.

The court found him guilty of committing a criminal offense under Part 3 of Art. 190 of the Criminal Code of Ukraine and sentenced him to imprisonment for a period of 4 years.

At the same time, in order to achieve the purpose of punishment provided for in Art. 50 of the Criminal Code of Ukraine, which establishes that “punishment is intended not only to punish, but also to correct the convicted, as well as to prevent the commission of new crimes by both the convicted and other persons,” the court decided to apply the provisions of Art. 75 of the Criminal Code of Ukraine and release him from serving his sentence with probation.

“The court believes that such a punishment will be sufficient, fair and necessary to correct the accused and to prevent the commission of criminal offenses by both him and others,” the case states.

Thus, a Ukrainian who cheated at ATMs avoided imprisonment, provided that he does not commit a new crime during the 2-year probation period.
