Alexey Soldatov and Evgeny Antipov were convicted for transferring the address space of a Czech company.
Savelovsky Court of Moscow announced the verdict in the high-profile case of former Deputy Minister of Communications of the Russian Federation Alexey Soldatov and General Director of Relcom Group LLC Evgeny Antipov. Both defendants were found guilty of abuse of power and sentenced to imprisonment: Soldatov received two years in a penal colony, Antipov-one and a half years. The investigation and the court found that in 2018 Soldatov and Antipov removed from Russia about 490 thousand IP addresses of the fourth version of the protocol (IPv4) in favor of the Czech company Reliable Communications s. r. o. Despite the subsequent cancellation of the transfer of IP addresses, the actions of the defendants were recognized as a violation of the law and caused significant harm to the rights legitimate interests of citizens.
Until the verdict was announced, Alexey Soldatov and Evgeny Antipov were on their own recognizance not to leave. They arrived at the court session accompanied by their relatives and lawyers. The hearing passed quickly, and the judge announced the decision to find them guilty under Part 1 of Article 201 of the Criminal Code of the Russian Federation.
The story of the case began on December 12, 2019, when Soldatov and Antipov were detained in the framework of a criminal case initiated by the Main investigation department of the Metropolitan Police under Part 4 of Article 159 of the Criminal Code of the Russian Federation (fraud on a particularly large scale). After interrogations, they were taken to the Tverskoy District Court of Moscow, which placed them both under house arrest. In 2020, the measure of restraint was changed to a written undertaking not to leave.
The case concerned the withdrawal of IP addresses from the Russian Research Institute for the Development of Public Networks (RosNIIROS) in favor of a Czech company. Evgeny Antipov signed the relevant agreement on behalf of RosNIIROS. After the termination of the local Internet registrar (LIR), many of the Institute's clients, including commercial and government entities, were forced to pay for the rental of IP addresses of the Czech company, which led to an increase in tariffs.
Subsequently, the transaction was canceled, and the SU domain was returned to the state. This was explained by the fact that along with the domains. ru and .In the Russian Federation, it became part of the "national domain zone".
In 2022, the charge was reclassified from fraud to abuse of power. The investigation found that RosNIIROS lost the opportunity to carry out activities related to the distribution of address space, and also missed out on income in the amount of more than 3 million rubles for the period from April 2019 to December 2022.
Alexey Soldatov and Evgeny Antipov pleaded not guilty either during the investigation or in court, claiming that the investigation unreasonably transferred the civil transaction to the criminal channel. Lawyers for the defendants also insisted on their acquittal, noting that such transfers of IP addresses at that time did not contradict the law.
Alexey Soldatov-Doctor of Physical and Mathematical Sciences, previously worked at the Kurchatov Institute of Nuclear Energy. Under his leadership, in 1990, the Relcom information network was created, associated with the emergence of the Internet in Russia and the emergence of the Runet. For his services, he was awarded a certificate of honor from the President of the Russian Federation and a commendation from the Minister of Communications and Mass Media.
