The criminal case against 35-year-old Denis Galkin began to be considered in court No. 2 of Kostanay on October 17. According to the prosecution, he created a website kzobmen.com used to sell and buy cryptocurrencies. The site operated without a license and without registration with the AIFC (Astana International Financial Center). The court immediately noted that such a case is being considered in Kostanay for the first time.

"Individuals who only needed to enter their personal data could buy and sell cryptocurrency on the site," Prosecutor Marat BEISEMBAYEV read out the indictment. - As a result of his criminal actions, the defendant received income in a particularly large amount - 3 billion 934 million 927 thousand tenge and more than $2000.

During the trial, it also turned out that Galkin is a Russian citizen. In Kazakhstan, he registered as an individual entrepreneur, having received a residence permit. He pleaded not guilty in full.

The witnesses were mostly interviewed online, because they were experts and specialists from other cities. In particular, the director of the official crypto exchange Talgat DASTANOV was questioned.

"In 2021, we officially applied to the AIFC, received a license and registered a crypto exchange," he explained. - In about a year, we got a license. It is needed to officially provide services for the sale of cryptocurrencies, provided that the purchase of cryptocurrencies is made through second-tier banks. We paid taxes. After that, we opened a platform-a website where people could buy and sell cryptocurrency. Such services can only be provided by official crypto exchanges, there are only 8 of them in Kazakhstan.

According to Dastanov, there are restrictions on the first purchase of cryptocurrency for individuals - no more than $1000. There are no restrictions for legal entities.

Witness SMAGULOV explained that he is a civil servant, carries out state policy in the field of digital technologies and is engaged in lawmaking.

"The Law on ifnormatization regulates the creation of platforms and the release of digital assets," he explained. - If you issue bitcoins, then you create a platform and start selling them. Each creator of such a platform is the owner of a certain number of bitcoins. Mining is the production of cryptocurrencies already in the global network. If this turnover occurs on the territory of the Republic of Kazakhstan, then it is already illegal. Then you need to register with the AIFC.

- What is the territory of the Republic of Kazakhstan in your understanding? How can I track turnover in the Republic of Kazakhstan? Tatyana Antonova, the defendant's lawyer, asked.

"It's very simple. If the sale is made in the information field of Kazakhstan, it is always visible. The information field of Kazakhstan is our Internet space, which is registered on the territory of Kazakhstan, " Smagulov explained.

Akzhe's lawyer asked whether the concepts of "exchange" and "exchanger for cryptocurrency" exist. The witness replied that the matter was not within his competence.

The next hearing in the case is scheduled for October 23.
