What are the consequences of a cyberattack on the global justice system?

The International Criminal Court (ICC) said on Tuesday that its computer system was hacked. The security breach occurred at one of the most prominent international organizations that handles confidential information about war crimes.

The ICC detected unusual activity on its computer network late last week, prompting a reaction that continues to this day. A court official declined to comment on the severity of the hack, its complete elimination, or possible culprits.

The ICC said in a short statement: "Immediate measures have been taken to respond to this cybersecurity incident and mitigate its consequences."

A source of the NOS publication said that a large number of confidential documents were stolen as a result of the attack. The ICC did not confirm this information.

The court said in a statement that it continues to "analyze and mitigate the consequences of this incident" with the help of the Dutch government and is strengthening its cybersecurity measures.

A spokesperson for the Dutch Ministry of Justice confirmed that the country's National Cyber Security Center is supporting the investigation.

The president of the ICC Bar Association, Marie-Helene Preul, said lawyers for the accused and victims had suffered "as much as the court staff" from the security measures taken.

In August 2023, ICC Prosecutor Karim Khan said that cyber attacks could form part of future war crimes investigations. He warned that the ICC itself could be vulnerable.

"Misinformation, destruction, alteration of data, and leakage of confidential information can hinder the administration of justice at the ICC," he wrote in a report by Foreign Policy Analytics, a Microsoft-funded think tank.

"But prevention remains better than cure."
