The Ministry of Public Security and the State Internet Information Administration of China have submitted a draft of a new "Regulation on the National Identity Identification Network"for discussion. This step is aimed at strengthening the protection of citizens ' personal information and creating a reliable system for online identity verification.
The new law is based on key Chinese laws such as the Cybersecurity Law, the Data Protection Law, the Personal Data Protection Law, and the Telecommunications and Internet Fraud Prevention Law. This provides a solid legal basis for implementing the new system and ensures that it complies with existing data protection and cybersecurity standards.
A key feature of the new system will be the introduction of a" network number "(net ID) and a "network certificate" (net certificate). These tools will allow users to securely register and verify their identity online without disclosing personal data.
A network number is a unique identifier consisting of letters and numbers that will correspond to the personal information of a citizen. A network certificate is a digital identity that contains a network number and encrypted personal data. It is important to note that obtaining these digital IDs will be voluntary for citizens over the age of 14.
The new system will help minimize the collection and storage of personal data, which will reduce the risk of information leakage. The platform will only provide the results of identity verification without the need to store complete data. In cases where this is necessary, the data will be stored only with the user's consent and in the minimum required amount.
The draft law also includes strict requirements for the processing and protection of personal data. Users should be informed about the purposes and methods of processing their data, as well as about their rights and measures to protect information.
The project pays special attention to the protection of the rights of minors. For children under 14 years of age, digital IDs can only be obtained with the consent of their parents or guardians. Teenagers from 14 to 18 years of age will be able to get a network number and certificate under adult supervision.
The new rules encourage Internet companies to implement this system. If the user has been identified through the national platform, the services will not be able to request additional personal information. This can significantly reduce the risks of data leaks and misuse.
The Ministry of Public Security and the State Internet Information Administration will monitor the operation of this system and monitor compliance with data security requirements.
