Two Miami, Florida, teenagers are on trial for creating and distributing fake nude images of their peers using AI technology. The 13-and 14-year-olds used an unnamed artificial intelligence app to generate candid snaps of classmates aged 12-13.

The boys were charged with a third-degree felony under Florida's 2022 law, which criminalizes the distribution of deepfake images of a sexually explicit nature without the victim's consent. This is the first recorded case of criminal prosecution for such an act.

Local media reported the incident after the administration of Pinecrest Cove Academy in Miami suspended the accused from classes on December 6. On December 22, the teenagers were arrested on charges of distributing obscene materials.

The parents of the victims demanded to exclude the accused from school. One of the victims admitted that she felt " insulted and used." Lawyers note the strangeness of the fact that fake nude photos are subject to more severe penalties than for distributing real intimate materials.

Despite the criminal liability, lawyers doubt the expediency of tough measures for juvenile offenders, pointing out the need for a deterrent, but not punitive effect.

While almost all states have laws against revenge pornography, few explicitly regulate the creation of intimate content using AI. For example, the Beverly Hills Police Department is investigating a similar case where students shared nude deepfake images of their classmates. However, local legislation does not explicitly address the issue of AI-generated images.

The problem of AI porn has also affected celebrities. Earlier, the social network X was forced to limit the search by the name of Taylor Swift due to the influx of obscene photos of the singer generated by neural networks.
